Joshua Walker Smith was charged in June, accused of driving a four-wheel-drive into Mr Sams in a Cessnock backyard in September, 2018.
Newcastle Local Court heard on Wednesday that police were waiting for a specialist Accident Reconstruction Report to be filed.
But the court heard the Melbourne-based professor enlisted to compile the report had not yet been able to visit the crime scene because he had been stuck in lockdown in the Victorian capital.
The matter was adjourned to December 23.
