The Environment Protection Authority has taken action in the Land and Environment Court against Rutherford waste oil refinery Truegain and one of its directors.

The company and the director each face two charges which, if proven, carry a maximum penalty of one million dollars each.
“The EPA alleges the company and the director failed to comply with environment protection licence conditions and provided false and misleading information to the EPA,” it said in a statement released on Thursday.
Truegain is based in the Rutherford Industrial Estate.
“Truegain’s environment protection licence requires it to conduct air emissions monitoring for dioxins and furans, gases which could pose potential harm in uncontrolled concentrations,” the EPA said.
“The monitoring is an important requirement under the licence and is there to ensure the processing plant is operating effectively and is not posing a threat to the environment or community.”
It is alleged that in 2012-2013, this monitoring was not undertaken and that Truegain provided false and misleading information to the EPA in its 2012-13 annual return.
“The annual report did not disclose that Truegain had failed to carry out the monitoring,” the EPA said.
The matter has been listed for directions in the Land and Environment Court on Friday, May 15.
